General Terms and Conditions of Sale B2B
Business principles applicable to professional accounts and orders destined for the US market.
1. Purpose and acceptance
These terms and conditions govern account requests, quotes, orders, deliveries, and services provided by WATER 808 USA LLC. All orders become binding only upon written confirmation from WATER 808 USA, acceptance of the quote, and receipt of the required payment.
2. Formats and availability
The commercial formats offered in the United States are 40 cl and 75 cl glass bottles, in the references validated by WATER 808 USA. Products, stock levels, labeling vintages, packaging, and mixed-pack options remain subject to availability and written confirmation.
3. First order and account opening
The minimum order for opening an account is five (5) pallets. This triggers the review and opening of the business account after legal, commercial, and logistical validation by the client. WATER 808 USA may request company information, EIN (European Business Identification Number), resale certificate, licenses, references, and other necessary documents.
4. Full payment required
The first order is payable in full before shipment. Unless otherwise agreed in writing, no preparation, freight booking, or shipment will occur until payment has been received. Payment covers the products and costs listed in the quote, including preparation, transport, freight, customs, import, handling, and delivery.
5. Preparation and initial timeframe
The first order is prepared directly at the source in France. The average delivery time is thirty (30) to thirty-five (35) working days, with a maximum of thirty-six (36) working days under normal conditions, from the date of full order validation and receipt of full payment.
6. Importation and controls
The schedule includes goods preparation, port transport, ocean freight, French and U.S. customs formalities, applicable import obligations, receipt at the U.S. warehouse, and final delivery. Food imports may be subject to FDA, CBP, Prior Notice, FSVP, inspection, detention, or documentary requirements.
7. Delays and external events
The desired dates remain indicative until written confirmation. Delivery times may be extended due to port, carrier, customs, FDA or CBP inspections, weather, congestion, unavailability, strikes, force majeure, or any event reasonably beyond the control of WATER 808 USA. The client will be notified as soon as possible of any significant delay.
8. Restocking
After account activation and the first delivery, the minimum reorder is one (1) pallet. Orders available from US stock are generally prepared within twenty-four (24) to forty-eight (48) hours, subject to availability, payment, and validation.
9. Delivery to the United States
Orders are shipped from the US warehouse to the confirmed address. Delivery typically takes three (3) to seven (7) business days, depending on the destination and carrier. Pickup may be available upon request. Shipping costs are provided before final confirmation.
10. Reception, reservations and quality
The customer must check the quantities, batches, packaging, and any damage upon receipt. Any anomalies must be noted on the carrier's documents and reported promptly with photographs and supporting documentation. Products must be stored protected from frost, excessive heat, sunlight, and any contamination.
11. Contractual Scope
The accepted quote, the confirmed purchase order, the specific terms and conditions, and these terms and conditions constitute the applicable commercial agreement. In case of conflict, the written and signed specific terms and conditions shall prevail. This document must be finalized with the legal counsel of WATER 808 USA LLC before final commercial commencement.
Average delivery time is 30 to 35 working days, with a maximum of 36 working days from validation and receipt of full payment.
Regulatory Note
Imported bottled beverages and water into the United States are subject to applicable FDA and customs regulations. Confirmation of an account request does not constitute regulatory approval or a guarantee of delivery date.
